https://www.playtheraregame.com/ (the “Website”) is owned and operated by Chiesi Farmaceutici S.p.A., an Italian company with registered office in Via Palermo 26/A, 43122 Parma, Italy. (hereinafter referred to as “Chiesi”, “we”, “us”, “our”).

This Website is a platform designed for Chiesi customers (the “User”, “you”, “yours”), through which they will be able to order Chiesi branded gadgets and material. To access the Website, you must carefully read and accept the terms and conditions (the “Terms”) set out below. If you do not accept the Terms, you should leave the website and stop using any of the services provided on it.

(1) Access to the Website

To access and use the Website you must register and create an account (the “Account”) by providing a valid email address, a password, and any other information indicated as required. More details on how we process personal data in the dedicated Privacy Notice.

Chiesi will always do its best efforts to make sure the Website is always available and properly working. Nevertheless, we shall not be liable if, for any reason, the Website is unavailable, even if only for limited periods of time. Access to the Website may be suspended, without prior notice, in the event of system issues, service, maintenance, or for any other reason beyond the reasonable control of Chiesi.

The User is responsible for keeping its credentials secure. Chiesi will not be liable for any loss or damage arising out from any compromised Account and/or failure in keeping your credential confidential.

A breach or violation of the Terms may result in an immediate termination of your Account.

(2) Intellectual Property rights

All copyright, intellectual property right, and any other right relating to products, processes, and technologies described in the Website belong to Chiesi. You are authorized to use and reproduce the content of the website for internal information only, provided that: (i) the content is not modified in any way; (ii) graphic elements are not separated from the related text; (iii) you provide a copyright disclaimer mentioning all rights are reserved to Chiesi.

Any publication or commercial use of the material on the Website without the express consent of Chiesi is forbidden. Any other right or permission not expressly mentioned in this Terms shall be considered reserved. Other parties’ intellectual property will be identified wherever possible and Chiesi will acknowledge their rights.

All the information published on the Website is produced without any guarantee. Chiesi will always do its best efforts to ensure information published on the Website is accurate and up to date, but this does not imply any warranty regarding the accuracy and reliability of such content. The content included in the Website are provided to you for information purposes only and without any guarantee, condition, or other provision.

Chiesi may periodically update the Website and its contents, including product descriptions and availability, without notice.

(4) Limitation of liability

To the extent permitted by applicable laws, Chiesi shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the Website.

The User will indemnify and hold Chiesi and its parent, subsidiaries, affiliates, officers, directors, agents, employees, and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to your breach of these Terms, violation of any law or the rights of a third party.

This limitation of liability does not intend to exceed mandatory legal limits or those for cases of malice or gross negligence.

(5) Applicable law

This Terms shall be interpreted and governed by Italian law. All the disputes arising out of these Terms will submit to the jurisdiction of the Court of Parma.

(6) Additional provisions

The User shall not share any confidential or proprietary information through this Website unless there is another agreement with Chiesi regulating the sharing of such information. All the information will be considered as non-confidential, except for personal information covered by our Privacy Notice.

These Terms are not intended to modify or amend any agreement currently in place between the User and Chiesi.
